What is a Debtor?
The “Debtor” is the person who owes you the money. A debtor can be a person or a company. It is important to identify the debtor correctly or you may have difficulty recovering the debt.
If you engaged with a person, ensure that you have their name, address and some form of identification (such as a driving licence).
If you engaged with a company, ensure that the ABN or ACN of the business entity has been correctly identified in the contract. It is also good practice, if contracting with a company (XYZ Pty Ltd for example) that you get a director or directors guarantees (a personal guarantee over the debts of the company), and/or a charging clause, and/or security for the debt.

An ACN is an Australian Company number. You can search for an ACN – https://asicconnect.asic.gov.au/. An ACN will identify the company when you Submit Debt Online and will help to identify if their are any potential problems, such as the company in administration, liquidation or been wound-up.
